Independent experts that phrase their directions as if you have no choice should always be told (politely) to watch their language.
The object of referral to an independent expert is to get the rent you want determined by someone with no vested interest in the outcome. To get an IE on your side from the start it’s important to remind them who’s boss so that they’ll agree with you. If you give them what they want in a statement of agreed facts then you risk allowing them to think they are in charge. It’s a balancing act. There are lots of ways to be helpful without giving answers on a plate.
