Arbitration Act 2025 time limit for appeal to start when the resultant rent was notified
11 May 2025(2025 May) – Under the Arbitration Act 2025, s70(3) the time limit for appeal pushes the date of the award to the back burner by also including “the applicable date” which is the date when the applicant or appellant was notified of the result of that process.
Under the 1996 Act, the arbitrator can be asked to not date and sign the award until it is released to the parties, but in my experience arbitrators generally are prone to refusing.
The benefit of this charge will be felt. Where one or both parties have difficulty in finding thousands of pounds to meet the arbitrator’s requirement for all costs to be paid before the award is published, only to find that when that happens the time limit for appeal has passed, the clock won’t start ticking prematurely.
